According to a judgment rendered on March 29, 2023, the Court of Cassation ruled which the provisions of article P.6.3.0.3. the rules of procedure of the Paris Bar (RIBP), which allow the lawyer to exercise the activity of sports agent, were to be canceled.
Jean-Baptiste Guillot answered the questions posed by the LJA, in particular on the possibility for lawyers to exercise the activity of sports agent, on the reception of such a decision by lawyers in the sector, and on the consequences of this stop.
« The law of March 28, 2011 allowed lawyers to exercise the activity of sports agents. The purpose of this article was to broaden the scope of professional practice for lawyers. There was also the desire to moralize the transfers of players, with the idea of involving more lawyers, whose ethics are strict, in these operations.
« For my part, I consider that this does not change our activities as lawyers in sports law and/or for the sports industry. ; It's not our role to go to stadiums on Saturday mornings to find new talent. […] In practice, there was no competition between lawyers and sports agents and the players in the sector worked together. The judgment has come to redefine the scope of intervention of the two professions, but basically it's "much ado about nothing ».
