Divorce and liquidation of the matrimonial regime: patrimonial aspects

Agathe Lévy-Sebaux participated in the 29th ACE congress (Business Consulting Lawyers) in Marseille. She led a workshop on liquidation techniques for matrimonial regimes with Céline Cadars-Beaufour, Adeline Pourcin and Stéphane Flandin. This workshop made it possible to address the many questions which arise when one has to liquidate a matrimonial regime.

How to determine the applicable law? What is the matrimonial regime of the spouses? What are the different stages of a matrimonial regime liquidation? Is the winding-up of the acquisition participation scheme so complex? Under what conditions can we claim covers? How to calculate a reward? a claim between spouses? a participation claim? How to promote the heritage to be shared? What discounts can be applied? Should we take into account latent taxation? How to set up administration accounts?

All these questions are addressed in the context of divorces, whether amicable or contentious, but are also the first step in settlinga succession of a spouse.

The participants' knowledge was tested in the form of a quiz through very concrete questions.
